When the workplace is excluded from the employer's direct supervision, employees are responsible for certain health and safety at work responsibilities. However, it is first the managers’ task to properly fulfil duties in this regard to enable their subordinates to adapt remote workstations to the required standards, including those related to ergonomics. “The employer must prepare an occupational risk assessment before assigning employees to work remotely. This is not a new obligation, but the amendment clarifies that when assessing occupational risk, the employer should specifically consider the impact of remote work on human vision, the musculoskeletal system, as well as the psychological and social conditions of remote work” says Paulina Grotkowska, Counsel in Bird & Bird’s Employment team in her recent interview with MarketNews24. Notably, for the sake of the employers’ convenience, the amendment makes it possible to create a universal occupational risk assessment for specific groups of remote jobs. Another new task also imposed on the employer is to prepare rules on safe and hygienic work performed remotely. The document should set out the rules and guidelines on how to properly organize the remote workplace to comply with the requirements of ergonomics and ensure safe, hygienic working conditions, which activities are to be performed upon completing remote work, and what principles apply when handling emergency situations that might pose a threat to human life or health. “The employer will be required to present personnel with these documents. Nowelizacja pozostawia wątpliwości, które staną się problemem dla pracodawców i pracowników. W odróżnieniu od nadal obowiązujących przepisów dotyczących telepracy czy pracy zdalnej świadczonej w ramach tzw. specustawy covidowej, wprowadzono zmiany, z których najważniejszy jest wyraźny obowiązek pracodawców pokrywania pracownikom kosztów związanych z pracą zdalną. Pod reżimem telepracy praktyki pracodawców rzeczywiście były mocno odmienne. Jedni nie refundowali żadnych kosztów pracy na odległość, traktując ją jako benefit sam w sobie. Inni z kolei przyznawali miesięczny dodatek. Jednak wątpliwości budziło to, jakie koszty powinien on obejmować, gdyż przepisy nie były jasne w tym względzie. Niestety, pomimo długich prac legislacyjnych nowe regulacje nadal nastręczają wątpliwości. Ale to co wiemy na pewno: • Pracodawca jest zobowiązany do zwrotu pracownikom podwyższonych kosztów energii elektrycznej oraz kosztów Internetu związanych z pracą zdalną z domu. • Zwrot takich rzeczywiście poniesionych kosztów (1:1) może być zastąpiony ryczałtem odpowiadającym ich przewidywalnej wysokości. • Zwrot kosztów pracy zdanej czy też wypłata ryczałtu w to miejsce jest zwolniona z obciążeń publicznoprawnych typu PIT i ZUS. Pracodawcy powinni rekompensować jedynie koszty energii elektrycznej i usługi internetu, których sami bezpośrednio nie zapewniają do pracy zdalnej. Może więc wystąpić sytuacja, w której grupa pracowników korzysta z własnych telefonów, a druga grupa – z telefonów służbowych, których abonament opłaca bezpośrednio pracodawca. Z tego powodu wysokość ryczałtu dla różnych grup pracowników może się różnić. Ryczałt powinien odzwierciedlać takie różnice, niezależnie od innych kwestii wpływających na koszty związane z faktycznym czasem pracy z domu, w tym: • wymiaru zatrudnienia pracownika (pełny/niepełny etat), • wymiaru pracy zdalnej w 100 % lub pracy hybrydowej. Kolejnym kamyczkiem do ogródka wątpliwości jest kwestia absencji pracownika w danym miesiącu w związku np. chorobą czy urlopem i ich ewentualnym wpływem na wysokość ryczałtu do wypłaty. Z jednej strony organy podatkowe w indywidualnych interpretacjach podatkowych dotyczących ustawy covidowej zajmowały stanowisko o braku konieczności uwzględnienia tej kwestii przy wypłacie. Z drugiej jednak ryczałt ma odpowiadać przewidywanym kosztom. Dlatego spodziewać się można dość ostrożnościowego podejścia pracodawców i odmowy wypłaty całości bądź części ryczałtu, zwłaszcza gdy absencja trawa cały miesiąc lub jego większą cześć (np. w związku z ciążą lub macierzyństwem). The changes include extending parental leave by nine weeks if the leave is used by just one parent. In practice, this means that if a mother consumes her entire current parental leave entitlement, the nine-week pool can only be used by the father of the child. More entitlements will be enjoyed by parents of children up to eight years of age. They will have the right to refuse to work at night, to perform overtime or to travel for work-related purposes. At the same time, employers will be required to make it easier for such parents to work remotely or to work flexible hours. Two changes will apply to all employees: Emergency leave of 2 days or 16 hours (with the right to payment for such absences of one half of the salary due) and unpaid care leave of up to 5 days to take care of a family or household member. Employers should monitor parental rights to prepare themselves for the challenges posed by effective work organisation and leave of absence management. How will remote working be impacted? The changes establishing a firm place for remote working in the Labour Code entailed more than two years of legislative work and are likely to take effect as early the first quarter of 2023. The new definition of remote working establishes a clear-cut distinction between that term and teleworking. – The fossil-like regulations on teleworking and temporary solutions of the Covid-19 Special Act will be replaced by regulations on remote working. They will be more flexible and adapted to suit the current working environment and market conditions – says Paulina Grotkowska in her interview with MarketNews24. The new definition of remote working introduced into the Labour Code lays down a clear-cut distinction between this term and teleworking. The aim is to make long-term remote working more flexible and popular. Remote working will be implemented in the workplace on a basis paralleling that applicable to teleworking, but with one difference. The new Labour Code regulations will impose minimum (and quite extensive) content requirements for regulations or agreements governing remote working. They will also result in additional obligations for employers, including the requirement to define what groups of employees are covered by the new solutions and what principles will apply with regard to work supervision, information security and personal data protection as well as how employees are to be reimbursed for the costs they incur when working remotely, etc. Additionally, employers will be granted a new right to unilaterally instruct employees to perform remote work (namely, without the need to secure employee consent), but only in exceptional circumstances and for a defined period of time. Hence, in all standard situations, remote working will entail the need for arrangements to be concluded with specific employees, including arrangements as to the place from which they will work remotely. It will become obligatory for employers to cover costs incurred by employees when working remotely. New workplace health and safety solutions will mean that the existing ones will have to modified when applied to remote working. What are the practical consequences for employers? – Once the amended law takes effect, each organization where employees perform work from outside the office will be required to adjust the forms of remote working that are currently in use to the new regulations – adds Paulina Grotkowska. As an alternative to the new obligations regarding remote working deriving from the Labour Code, employers may decide to change how employees perform their work, namely by requiring them to work from offices, or by placing a limit on remote work of up to no more than 24 days per year. This will then be treated as what is termed occasional remote working. The provisions of the Labour Code have now been extended to cover the latter.
